Terms of Service

1. Acceptance of Terms

By accessing or using any Alpha Pod service, Discord server, content, or materials (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Services.

By using the Services, you affirm that you are at least 18 years of age and are legally competent to enter into these Terms. If you are accessing the Services on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Description of Services

Alpha Pod LLC ("Alpha Pod," "we," "us," or "our") provides educational and informational trading content and tools, including but not limited to:

  • Real-time SPX 0DTE options trade alerts delivered via Discord, SMS, and email
  • Daily and intraday market analysis and morning notes
  • Proprietary TradingView indicators, including "KASM SPX Daily Levels" and "KASM Institutional Zones"
  • Algorithmic stock screening and signals ("Kairos")
  • Discord community access and member interaction
  • SMS and email notifications for trade alerts and updates
  • Educational resources, guides, and academy content

All content is delivered through Discord, the Alpha Pod website (alphapodtrading.com), SMS, email, and authorized third-party platforms. We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time with reasonable notice.

3. Not Financial Advice — Risk Disclosure

ALL CONTENT PROVIDED BY ALPHA POD IS FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY. WE ARE NOT REGISTERED INVESTMENT ADVISORS, BROKER-DEALERS, FINANCIAL PLANNERS, OR FIDUCIARIES WITH THE SEC, FINRA, OR ANY OTHER REGULATORY BODY.

Nothing published, communicated, or transmitted by Alpha Pod constitutes a recommendation, solicitation, or offer to buy or sell any security, futures contract, or options contract. All trade alerts, signals, and analysis are provided solely for educational and informational purposes.

Trading options involves substantial risk of loss and is not appropriate for all investors. Options can expire worthless, resulting in the total loss of premium paid. You should carefully consider your financial situation, investment objectives, risk tolerance, and experience before trading options. Past performance of any alert, signal, indicator, or strategy does not guarantee future results.

You are solely and entirely responsible for your own investment and trading decisions. The simulated or hypothetical portfolio results shown on our website or in our marketing materials do not represent actual trading results and have inherent limitations. Simulated results do not account for real-world factors including slippage, commissions, execution differences, market impact, and liquidity constraints. Actual results may differ materially from simulated results.

Always consult a qualified financial professional before making investment decisions.

4. Subscription & Billing

Access to Alpha Pod's premium Services requires a paid subscription, managed through Whop. By subscribing, you authorize Whop to charge your payment method on a recurring monthly basis at the then-current subscription rate.

  • Cancellation: You may cancel your subscription at any time with one click through your Whop account dashboard — no phone calls, retention pitches, or email required. Your access will continue through the end of your current billing period.
  • No Refunds: Subscription fees are generally non-refundable. We do not provide partial-month refunds upon cancellation.
  • Price Changes: We reserve the right to change subscription pricing. We will provide at least 30 days' advance notice of any pricing changes via email or Discord.
  • Free Trials: Free trial periods, if offered, automatically convert to paid subscriptions at the conclusion of the trial period unless you cancel before expiration. You will not be charged during the trial period.
  • Failed Payments: If a payment fails, your access may be suspended until payment is successfully processed.

5. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You expressly agree that you will not:

  • Redistribute, resell, sublicense, share, re-broadcast, or otherwise make available Alpha Pod content, trade alerts, or signals to any third party without our express written consent
  • Use automated tools, bots, scripts, or other means to scrape, copy, or extract content from the Services
  • Impersonate Alpha Pod, its employees, representatives, or any other person or entity
  • Use the Services for any illegal, fraudulent, or unauthorized purpose
  • Harass, abuse, threaten, or intimidate other members of the Alpha Pod community
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of any proprietary indicator, algorithm, or software
  • Post or transmit any content that is defamatory, obscene, or otherwise objectionable
  • Interfere with or disrupt the integrity or performance of the Services

Violation of this Acceptable Use policy may result in immediate termination of your account and access to the Services without refund or further obligation on our part.

6. Intellectual Property

All content, materials, trade alerts, indicators, algorithms, software, branding, design, text, graphics, and other materials made available through the Services are the exclusive property of Alpha Pod LLC or its licensors and are protected by copyright, trademark, trade secret, and other intellectual property laws.

"Alpha Pod," "KASM," "Kairos," "King Levels," "KASM SPX Daily Levels," "KASM Institutional Zones," and associated logos and trade dress are trademarks of Alpha Pod LLC. You may not use these marks without our prior written permission.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your own personal, non-commercial purposes. This license does not include the right to: sublicense, sell, or resell the Services; copy or reproduce any content; modify or create derivative works; publicly display or perform any content; or use any data mining or similar data gathering methods.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALPHA POD LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Services will be uninterrupted, timely, secure, or error-free; (b) the results obtained from use of the Services will be accurate, reliable, or meet your expectations; (c) any content, including trade alerts, will be accurate, complete, or timely; or (d) any errors in the Services will be corrected. We make no guarantees whatsoever regarding trading outcomes, profitability, or investment returns.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALPHA POD LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, TRADING LOSSES, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, OR SYSTEM FAILURE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL ALPHA POD LLC'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SERVICES IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.

9. Indemnification

You agree to defend, indemnify, and hold harmless Alpha Pod LLC and its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your access to or use of the Services
  • Your investment or trading activities undertaken in connection with or following use of the Services
  • Your violation of these Terms
  • Your violation of any applicable law, regulation, or third-party right
  • Any content or materials you submit, post, or transmit through the Services

10. Modifications to Terms

We reserve the right to modify or update these Terms at any time at our sole discretion. When we make changes, we will update the "Effective Date" at the top of this page. Your continued access to or use of the Services after any modification constitutes your acceptance of the revised Terms.

We will make reasonable efforts to notify you of material changes via email or through an announcement in our Discord community. We encourage you to review these Terms periodically to stay informed of any updates.

11. Governing Law & Dispute Resolution

These Terms and any dispute arising out of or relating to them or the Services shall be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to any conflict of law principles that would require application of the laws of a different jurisdiction.

Any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction of such courts. You waive any objection to jurisdiction or venue in such courts.

Waiver of Class Actions: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

12. Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and Alpha Pod LLC regarding the Services and supersede all prior agreements and understandings.

Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Force Majeure: We shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control.
